Description:

The Applicant was eligible for, but was not nominated by Squash Australia, for selection as a team member for the 2022 Commonwealth Games; she was nominated as a reserve in the women’s doubles event. The Applicant appealed her non-nomination and claimed that Squash Australia had erred in the exercise of the discretion permitted by the Squash Australia Nomination Policy. The Applicant also appealed on the ground of bias. Three persons were identified as Interested Parties, and were entitled to be heard on the Application. The Applicant and two of the Interested Parties made submissions on the nominations process undertaken by Squash Australia. The Tribunal determined that the decision of Squash Australia was upheld and the Application was dismissed.
