Gymnastics Australia v Respondent
Pursuant to Gymnastics Australia’s Selection Appeals Policy (Policy), Gymnastics Australia appealed the NST General Division determination to select the Athlete to the International Championships team. The matter was validated on 19 May 2025 and determined on 21 May 2025.
The matter was heard in the NST Appeals Division by a Panel of three NST Members. The NST Members considered submissions and evidence from the Parties, including Interested Parties, relevant Gymnastics Australia policies, and the NST General Division determination subject to appeal.
Gymnastics Australia sought to establish that the NST General Division determination was an error of law. Gymnastics Australia argued that according to the Policy, the NST Member should have remitted the whole of the selection decision to Gymnastics Australia for its consideration and redetermination.
The appeal was dismissed.
The NST Members held that the decision made in the NST General Division was within its jurisdiction. Specifically, it was impractical for the whole of the selection decision be referred to Gymnastics Australia for it reconsider and redetermine, prior to the deadline set by the Federation Internationale de Gymnastique for International Championships team entry.
