Description:

The Applicant, Stop and Seal Team Racing, is a participant in the 2026 Australian Superbike Championships (the ASBK Championship). The Respondent, Motorcycling Australia, is the national sporting organisation with respect to Motorcycle sport in Australia. 

On 13 January 2026, the Respondent informed all participants in the ASBK Championship that an RPM limit was being introduced on Ducati V4R motorcycles to a maximum of 15,500 Revolutions Per Minute (the RPM limit). 

By mutual agreement, the parties referred the contention made by the Applicant that the introduction of the RPM Limit was not validly made under the Manual of Motorsport, General Competition Rules, and/or ASBK Sporting Regulations (the Relevant Rules) by the Respondent (the Application). 

The Application was validated on 4 March and determined on the papers on 20 March 2026, within the NST General Division before a single NST Member. 

In summary, the NST Member determined that the Respondent complied with requirements under the Relevant Rules in exercising its regulatory power to ensure homologation of the Ducati V4R machine engines, aimed to ensure parity for participants within the ASBK Championship. 

The Application was dismissed.
